Terms of Use

1. Acceptance of Terms

By accessing or using Realty Space ("Platform" or "Service"), you agree to be bound by these Terms of Use ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

Realty Space provides a web-based CRM platform tailored to real estate professionals for managing leads, communications, transactions, open houses, pre-construction projects, and other business activities.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

3. User Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use this Service. You agree to provide accurate, complete, and up-to-date information when creating an account.

4. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful or unauthorized purpose

• Interfere with or disrupt the Service or servers

• Attempt to gain unauthorized access to any portion of the Service

• Upload or transmit viruses or malicious code

• Use bots, scripts, or scraping tools without permission

Misuse of the Service may result in account suspension or termination.

6. Customer Data

You retain ownership of the data you input or upload into the platform ("Customer Data"). By using the Service, you grant us a limited license to use, store, and process Customer Data solely for the purpose of providing and improving the Service.

You are solely responsible for the legality, accuracy, and content of Customer Data. We will not use your data for marketing or resale purposes.

7. Subscription, Billing, and Refunds

Access to certain features of Realty Space may require a paid subscription. All fees will be clearly stated at the time of purchase and may be listed in Canadian dollars or other currencies.

Fees are non-refundable unless otherwise required by law or expressly stated in writing.

We reserve the right to modify pricing at any time with prior notice. Continued use of the Service after such changes constitutes your acceptance of the new rates.

8. Intellectual Property

The Realty Space platform, including all content, code, designs, trademarks, and technology, is owned by 1978778 Ontario Inc. or its licensors. You may not reproduce, distribute, modify, or create derivative works without prior written consent.

9. Confidentiality

Any proprietary information shared between you and Realty Space during the course of using the Service will be kept confidential and not disclosed to third parties without your permission, unless required by law.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or engage in conduct that harms us or other users. Termination does not affect your obligation to pay any outstanding fees.

11. Disclaimers

The Service is provided “as is” and “as available.” We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be error-free, secure, or uninterrupted.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including lost profits, loss of data, or business interruption.

Our total liability for any claims shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless 1978778 Ontario Inc. and its affiliates, officers, employees, and partners from any claim, demand, or loss arising out of your use of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal action must be brought in the courts located in Ontario, Canada.

15. Modifications to Terms

We reserve the right to update or modify these Terms at any time. We will notify users by posting the updated Terms on our website. Continued use of the Service after changes constitutes acceptance.
